This Terms of Use agreement ("Agreement") is a legally binding contract between you ("User" or "you") and LivelyGig LLC, a Washington State US corporation ("Company," "we," "us," or "our"). This Agreement governs your use of our Blocktrust Identity Wallet for Desktop Browsers ("Extension") and the services provided through our Extension, Website, or other hosted Services ("Services").
By using our Extension/Services, you agree to be bound by this Agreement, our Privacy Policy, and any additional terms that may apply to specific sections of the Extension or to products and services available on or through the Services.
We reserve the right to modify this Agreement at any time without giving you prior notice. Your use of the Extension/Services following any such modification constitutes your agreement to follow and be bound by the Agreement as modified.
Your use of our Extension/Services is also subject to the Company's Privacy Policy. Please review our Privacy Policy, which also governs the Extension/Services and informs users of our data collection practices.
You represent and warrant that you will adequately protect the private information which you control and hold in the Extension/Services. You are responsible for maintaining the security of your account information and for any unauthorized access to or use of your account due to your failure to secure this information.
The Extension/Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may use the Extension/Services only for lawful purposes and in accordance with this Agreement. You agree not to use the Extension/Services in any way that violates any applicable federal, state, local, or international law or regulation.
To access some parts of the Extension or use certain Services, you may be asked to create a user account. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account.
We reserve the right, in our sole discretion, to terminate your access to all or part of the Extension/Services, with or without notice, for any reason or no reason at all.
The Extension/Services are provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event will the Company, its affiliates or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Extension/Services.
You agree that all disputes between you and the Company (whether or not such dispute involves a third party) with regard to your relationship with the Company, including without limitation disputes related to this Agreement, your use of the Services, and/or rights of privacy and/or publicity, will be resolved by binding, individual arbitration under the American Arbitration Association's rules for arbitration of consumer-related disputes and you and we hereby expressly waive trial by jury. As an alternative, you may bring your claim in your local "small claims" court, if permitted by that small claims court's rules and if within such court’s jurisdiction, unless such action is transferred, removed, or appealed to a different court.
All matters relating to the Extension/Services and this Agreement, and any dispute or claim arising therefrom or related thereto (including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the King County, Washington, USA, without giving effect to any choice or conflict of law provision or rule.
This Agreement constitutes the entire agreement between you and the Company regarding the use of the Extension/Services. The failure of the Company to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
